Appeal Your Parking Citation

 

Step I - The Administrative Review

You have 21 calendar days from the date of your citation to file an online Administrative Review Citation appeal form. This form allows you to put in writing your explanation and reason for appeal. Please include a photo of your daily permit, semester permit, or disabled placard along with additional photographs that may help your reason for appeal. In addition, include semester permit number or disabled placard number if applicable.

This form will be reviewed by our department, and a decision will be mailed to you within (3) weeks.

Parking citations will generally not be dismissed for a lost or forgotten permit, for an improperly displayed permit, not knowing regulations, and not reading the signs. Please be specific in explaining why you feel the citation should be dismissed. If you do not agree with the findings of the Administrative Review, you have the option of going to step II.

Step II - The Administrative Hearing

You must have completed the Administrative Review process before requesting an Administrative Hearing. You may request to have a hearing before an Administrative Hearing Officer by coming in person to the department within 21 days after the decision of the Administrative Review has been mailed to you. The amount of the parking fine must be posted in the form of a check or money order at the time you file your appointment for an Administrative Hearing. If you do not agree with the decision of the Administrative Hearing Officer, you have the option of going on to Step III.

Step III - Notice Of Appeal For Parking Citation

You must have completed both the Administrative Review process and the Administrative Hearing in order to file a Notice of Appeal through the Stockton Superior Court-Civil Division. You are required to appear in person at Stockton Superior Court, located at 222 E. Weber Avenue, Room 100, Stockton, California within 20 days after mailing the Administrative Review final decision. The Court will require a $25.00 filing fee, plus any other applicable court charges and fees. The appeal is heard de novo with the parking agency's file in the case submitted as evidence of the violation.
