San Joaquin Delta Community College District adheres to all federal, state, and local civil rights laws prohibiting discrimination, harassment, and retaliation in employment and education. Title IX of the Education Amendments of 1972 is a federal civil rights law that prohibits discrimination on the basis of sex in federally funded education programs and activities. All public and private elementary and secondary schools, school districts, colleges, and universities receiving any federal financial assistance must comply with Title IX. The District does not discriminate in its admissions practice, in its employment practices, or in its educational programs or activities on the basis of sex/gender. Sex includes sex, sex stereotypes, gender identity, gender expression, sexual orientation, and pregnancy or parenting status.
The District is committed to creating and maintaining an environment free from any form of sexual misconduct. Sexual misconduct — including sexual assault, sexual harassment, dating and domestic violence, and stalking — is inconsistent with our District’s values and prohibited under Title IX, other federal laws and state and local laws, and District Policy. The District will investigate known incidents of alleged sexual misconduct, take immediate action to stop the behavior, prevent its reoccurrence, and address its effects. The District addresses sexual misconduct violations through the process outlined in Administrative Procedure 3434. The Title IX Coordinator and Title IX Co-Coordinators have been designated to handle such complaints.
What is Title IX
Title IX of the Education Amendments of 1972 (20 U.S.C. § 1681) is an all-encompassing federal law that prohibits discrimination based on the gender of students and employees of educational institutions which receive federal financial assistance.
"No person in the United States shall, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any education program or activity receiving Federal financial assistance..." 20 U.S.C. § 1681
Under Title IX, discrimination on the basis of sex can include sexual harassment, rape, and sexual assault. A college or university that receives federal funds may be held legally responsible when it knows about and ignores sexual harassment or assault in its programs or activities. The university can be held responsible in court whether the harassment is committed by a faculty member, staff or student.
