ARTICLE II
NON-DISCRIMINATION

2.1 Discrimination Prohibited: It shall be an unlawful employment practice, unless based upon a bona fide occupational qualification, or, except where based upon applicable security regulations established by the United States or the State of California for an employer, because of the race, religious creed, color, national origin, ancestry, physical handicap, medical condition, age (over 40), marital status, or sex of any person to refuse to hire or employ the person or to refuse to select the person for a training program leading to employment, or to bar or to discharge such person from employment of from a training program leading to employment or to discriminate against such person in compensation or in terms, conditions or privileges of employment.

2.2 No Discrimination on Account of Association Activity: Neither the District nor the Association shall impose or threaten to impose reprisals on employees, to discriminate or threaten to discriminate against employees, or otherwise to interfere with, restrain, or coerce employees because of their exercise of rights guaranteed by law

2.3 Alleged violations of section 2.1 shall be addressed under Section 13.2 of this contract.
