2.1 Discrimination Prohibited It shall be an unlawful employment
practice, unless based upon a bona fide occupational qualification, or,
except where based upon applicable security regulations established
by the United States or the State of California for an employer,
because of the race, religious creed, color, national origin, ancestry,
physical handicap, medical condition, marital status, or sex of any
person to refuse to hire or employ the person or to refuse to select
the person for a training program leading to employment, or to bar
or to discharge such person from employment or form a training
program leading to employment, or to discriminate against such
person in compensation or in terms, conditions, or privileges of
employment, (Government Code, Section 12940)
2.2 No Discrimination on Account of CSEA Activity Neither the District
nor CSEA shall impose or threaten to impose reprisals on employees,
to discriminate or threaten to discriminate against employees, or
otherwise to interfere with, restrain, or coerce employees because of
their exercise of rights guaranteed by law. [Government Code
3543.5(a); 3543.6(b)]
2.3 Alleged violations of Section 2.1 shall be addressed under Section
18.3 of this contract. Violations of any other section of this contract
shall be addressed under Section 18.2 of this contract. Utilization of
Section 18.3 shall not abridge employee's rights under state and
federal anti-discrimination law.
