Public Service Employment Disqualifiers
  1. Must be a U.S. Citizen or a permanent resident alien who is eligible and has applied for citizenship [GC§1031(a)]. Citizenship requirements for peace officers (Government Code section 24103). Citizenship requirements for deputy sheriffs and deputy marshals (Vehicle Code section 2267). Citizenship requirements for California Highway Patrol officers, be a U.S. citizen (Note: CHP officers must be U.S. citizens at the time of appointment VC§2267.)
  2. Must be at least 18 years of age [GC§1031(b)] . (Minimum age of 18 years for peace officer employment)
  3. Be a high school graduate, pass the General Education Development Test (GED) indicating high school graduation level, pass the California High School Proficiency Examination, or have attained a two-year, four-year, or advanced degree from an accredited college or university. The high school shall be either a United States public school, an accredited United States Department of Defense high school, or an accredited or approved public or nonpublic high school. Any accreditation or approval required by this paragraph shall be from a state or local government educational agency using local or state government approved accreditation, licensing, registration, or other approval standards, a regional accrediting association, an accrediting association recognized by the Secretary of the United States Department of Education, an accrediting association holding full membership in the National Council for Private School Accreditation (NCPSA), an organization holding full membership in the Commission on International and Trans-Regional Accreditation (CITA), an organization holding full membership in the Council for American Private Education (CAPE), or an accrediting association recognized by the National Federation of Nonpublic School State Accrediting Associations (NFNSSAA). (Government Code section 1031(e))
  4. Be free of any felony conviction or certain misdemeanor convictions that are disqualifying for employment as a peace officer [GC§1029; PC§12021(c); 18 USC 922(d)(9)]
  5. Be of good moral character as determined by a thorough background investigation [GC§1031(d)]. Failure to pass a fingerprint and criminal history check. (Government Code sections 1030 and 1031(c). Fingerprinting and search of local, state, and national files to reveal any criminal records).
  6. Be free of any physical, emotional, or mental conditions that might adversely affect the exercise of the powers of a peace officer [GC§1031(f)]
  7. Unable to read and write at the levels necessary to perform the job of a peace officer as determined by the use of the POST Entry-Level Law Enforcement Test Battery or other job-related tests of reading and writing ability.
  8. Illegal use of injected narcotics, steroids or hallucinogens; addicted to and/or habitual drug or alcohol user.
  9. Failure to file income tax returns
  10. Failure to register for the military draft (males)
  11. Financial irresponsibility
  12. Failure to disclose pertinent information in a personal history form.
  13. No valid California driver’s license and/or having a poor driving history (multiple citations, collisions, driving restrictions).
