| LITIGATION <This case is important because it was the first big case that publishers took legal action against a University for copyright violation. It is important to note two things about the case: 1) There was no verdict but only a settlement and 2) the NYU case was an easy case for the publishers to win because of the large amount of copying which was done (entire anthologies).> Addison-Wesley Publishing Co. V. New York University (S.D.N.Y. 1983) Facts: NYU (10 professors, and the copy center) were sued for assembling unauthorized anthologies sold to the students. Settlement: 1) Faculty required to seek permission, 2) NYU required to adopt the Classroom Guidelines, and 3) Faculty will be individually be liable in the future. |
